Nationwide fast-track deportations moved a step closer to reality after a sharply divided federal appellate panel sided with the Trump administration Tuesday, lifting a judicial block that had frozen the policy since August 2025. The 2-1 decision from the U.S. Court of Appeals for the District of Columbia Circuit removes a lower court injunction and restores the government's authority to carry out expedited removals anywhere in the country — without a hearing before an immigration judge.
Expedited removal as now configured lets Immigration and Customs Enforcement deport unauthorized immigrants who cannot demonstrate they have lived continuously in the United States for more than two years. The administration rolled out the expanded version during the opening days of President Trump's second term in January 2025. Before that change, the accelerated process applied only to migrants caught near the border or within two weeks of arriving.
Writing for the majority, Trump-appointed judges Justin Walker and Neomi Rao concluded that adequate due-process protections are built into the existing framework. "Make the Road has not shown that the expedited-removal process denies its members notice and an opportunity to be heard," the pair wrote. Judge Walker went further, rejecting the argument that officers must volunteer information about the two-year threshold, reasoning that such an obligation "would require immigration officers to provide what amounts to legal advice."
Circuit Judge Robert Wilkins, appointed by President Obama, filed a pointed dissent. He argued that the policy leaves migrants in the dark by neither requiring officers to ask how long someone has been in the country nor obliging them to explain the two-year rule. "Absent such knowledge, the noncitizen is simply left to hope that the immigration officer will conclude that they have met their burden of demonstrating two-years of continuous presence at the initial screening interview," Wilkins wrote, calling the arrangement a denial of due process.
The case originated with U.S. District Judge Jia Cobb, who blocked the expansion in August 2025 after finding that safeguards against erroneous removals were "woefully inadequate." Her ruling cited documented cases of people who had resided in the country well beyond two years yet still faced removal orders. The appellate majority acknowledged those mistakes but attributed them to "individual officers' failure to follow the law — not defects in the written directives under review."
Department of Homeland Security general counsel James Percival welcomed the outcome, saying the ruling "vindicated our decision to apply the law as written." He also took a jab at those who might still be weighing their options: "It's not too late to take a $2,600 check and a free flight home!" — invoking the administration's voluntary self-deportation incentive program.
Opponents of the policy signaled they are not finished fighting. Anand Balakrishnan, senior staff attorney at the American Civil Liberties Union and lead counsel for the plaintiffs, said the organization is "exploring next steps." "The Trump administration's push for fast-track deportations will subject people to an unfair and error-prone system," Balakrishnan said in a statement. "This ruling undermines the fundamental principle that people receive due process when the government seeks to deport them."
Make the Road New York Deputy Director Yaritza Mendez warned of sweeping consequences for immigrant families. "The Trump administration's attempt to expand expedited removal is just one of the many attacks that immigrant communities face daily," she said in a statement. "If allowed to move forward, it would severely undermine due process and lead to countless unjust or wrongful deportations, irreparably tearing apart families forever."
Tuesday's ruling fits within a broader administration drive to speed up removals across the board. In recent weeks the government assembled its largest-ever incoming class of immigration judges — even as it dismissed more than 100 sitting judges, some reportedly let go for failing to support mass deportation efforts. Separately, the administration has held immigrants without bond hearings, a practice that has generated its own wave of legal challenges, and has invoked the Alien Enemies Act of 1798 to expel hundreds of Venezuelan men alleged to have gang ties.
The decision takes effect immediately, leaving the plaintiffs the option of seeking emergency intervention from the Supreme Court.
